Inquiry into the New Hate Speech & Vilification Laws
A law this broad deserves a proper look. Victoria’s new vilification laws brought in new criminal offences from September 2025 and new civil protections from April 2026, and they rest on a vague “harm-based” test. No one knows exactly where the line sits. That is the problem.
This is not about protecting anyone who threatens or menaces another person. That is already wrong, and other laws already cover it. This is about a test so loose it could catch ordinary Victorians going about their lives.
A parent talking about faith at the kitchen table. A pastor reading from Scripture. A women’s group meeting to talk about sex-based rights. A person making a normal political argument. Under a fuzzy “harm” standard, any of them could be reported, dragged into a complaint, or hauled before a tribunal. That is not clarity. It is a trap.
We deserve to know what these laws actually do before people get caught in them.
The demand is simple. Hold a parliamentary inquiry into the new vilification laws.
I will fight for a full parliamentary inquiry into the Justice Legislation Amendment (Anti-vilification and Social Cohesion) Act 2025. Put the law under scrutiny. Get the answers on the record. Then fix what is broken.
Here is what the inquiry must examine:
- What “harm” actually means, and how far the test really reaches.
- Whether ordinary religious speech is being caught by the law.
- Whether normal political argument is being caught by the law.
- Whether “gender identity” as a protected attribute is being used to punish parents and women’s groups.
- Whether the law goes further than any real threat or incitement requires.
These are not radical ideas. They are the basics of good lawmaking: know what a law does, know who it hits, and fix it if it goes too far.
A law that can silence a parent or a women’s group needs answers, not silence.
